Who these terms are with

The FOKL website at fokl.ai is operated by Pando and Lily, LLC (“FOKL”, “we”), a Delaware limited liability company (1111B S Governors Ave STE 26199, Dover, DE 19904, USA). By using the site or joining the waitlist, you agree to these terms. If you don’t agree, please don’t use the site.

The waitlist

FOKL is pre-launch. Joining the waitlist reserves your place and lets us email you about early access. It is free, it is not a purchase or a contract to provide the product, and access will roll out in batches over time. We can’t promise a specific date, a specific position, or that any particular feature will exist at launch.

Waitlist invites & founding rewards

You’ll get a personal invite link. For every friend who joins through it and confirms their email:

• You move up the list. Early access goes out in batches, in order of how many confirmed friends each person has brought, and then by who joined first.
• You earn 50 Sparks for when FOKL opens.

Everyone who confirms a place on the waitlist also gets 100 founding Sparks, on top of the 100 every new account gets. A few fair-play rules:

• Founding and invite Sparks arrive the first time you sign in to FOKL with the same email address you joined the waitlist with. They expire 6 months after they arrive — they’re there to be used, and your feedback once you’ve used them is what we’re really after. Rewards not collected within 6 months of FOKL opening lapse.
• Because we’re still building, we may adjust the mechanics or amounts — we’ll keep it fair and honor the spirit of the offer.
• No gaming it: fake signups, bots, spam, or inviting yourself can forfeit your rewards and your place.

Sparks

Sparks are how FOKL is paid for. Building a tool, changing one, and letting a tool ask AI for help each spend Sparks; using tools you already have, starter tools, offline tools and sharing never do. What everything costs is on our pricing page: building and changing a tool each have a fixed price, and an AI answer is priced by how long it is — a short answer costs the least, and you’re only charged for the length you actually get. If something fails, you aren’t charged. Photos kept in tools you share are free up to a limit; past it, the tool’s owner pays a small monthly amount in Sparks, shown on the pricing page.

• Sparks you buy never expire. Sparks we give you — as a gift or as a thank-you, whatever it is for — expire 90 days after they arrive (founding and waitlist Sparks: 6 months, as above). We always spend the ones that expire soonest first.
• Sparks are a prepaid way to use FOKL. They have no cash value, can’t be exchanged for money or sold, and can’t be moved to another account — except that Sparks in a household wallet can be spent by that household’s members.
• Buying Sparks. Payments are handled by Stripe; we never see your card details. Where sales tax or VAT applies, it’s worked out at checkout based on where you are, and shown before you pay.
• Refunds. If you change your mind, we’ll refund the unspent Sparks from a pack bought in the last 14 days — just email us. Sparks you’ve already spent can’t be refunded. If you’re in the EU or UK, you have a right to withdraw from a digital purchase within 14 days; by spending Sparks you ask us to supply them straight away, and the refund above still covers whatever you haven’t spent. Nothing here limits refund rights the law gives you.
• Testimonials. If you write us a testimonial we give you Sparks once, whatever you say — good or bad. If we publish it, we’ll say you received Sparks for it.
• We may change how many Sparks things cost in future. A change never touches Sparks you’ve already bought, and we’ll show new prices before you spend.

Who can have an account — and family profiles

FOKL accounts are for adults — you must be 18 or older (or the age of majority where you live) to create one or to buy Sparks.

Children and teenagers use FOKL only through a family profile that a parent or legal guardian creates inside their own household. Family profiles are coming soon; this section applies from the day they’re available. If you set one up:

• You confirm you’re the child’s parent or legal guardian, and that you agree to what our privacy page says about family profiles. We may ask you to verify that in a way the law recognises before the profile can be used.
• You’re responsible for the profile — including what it builds and the Sparks it spends from your household. You can set a spending limit, require your approval before it builds, and see what it has spent and the names of the tools it has made.
• A family profile can’t buy Sparks, earn invite rewards, write testimonials, or share tools outside your household.
• You can change or delete a family profile, and everything we hold for it, at any time.

If we learn that a child has an account without a parent setting it up, we’ll close it and delete what we hold.

Emails

When you join, you consent to receive the confirmation email and occasional waitlist updates. You can unsubscribe from marketing emails at any time via the link in every email.

The tools you make

Your tools are yours. You own what you make with FOKL and what you put into it. We claim no ownership of your tools, and we do not use what you build to train anything.

To make FOKL work, you give us permission to store the tools you create and the conversations that produced them, so we can hand them back to you, let you change them, and pass them to people you choose to share with. That permission covers the tool — not the contents you put into it, which stay on your device and never reach us. Our privacy page explains exactly where that line falls.

You can take them and you can delete them. Export any tool, with its data, as one file at any time. Delete a tool and we delete our copy along with the conversation behind it. Close your account and the same applies to all of them.

Tools are built by a language model from what you describe, so we cannot promise a given tool is correct, complete or fit for any particular purpose — check anything that matters before relying on it. Don’t use FOKL to build something unlawful, and don’t share a tool you don’t have the right to share. We may remove a shared tool that breaks these terms.

Making a tool public is your choice. Anyone with a public tool’s link can see it, try it and take a copy of their own — the tool itself, including its name and any words written into it, but never what you’ve put in it. A public tool is also listed in FOKL’s Starter tools for everyone to find, shown as shared by you under your account name. You’re responsible for what you make public, you can stop sharing it at any time, and we may take a public tool down.

Acceptable use

Please use the site lawfully and don’t try to disrupt it, break its security, scrape it, or submit other people’s details without their permission.

Our content

The FOKL name, logo, copy, and design are ours. You’re welcome to share links to the site; please don’t copy our brand or content as your own.

Pre-launch disclaimer

The site and waitlist are provided “as is”, without warranties. FOKL is a work in progress: things may change, break, or be delayed, and we make no guarantee that the product will launch or perform in any particular way.

Limitation of liability

To the fullest extent allowed by law, FOKL isn’t liable for indirect or consequential losses arising from your use of the site or the waitlist. Nothing here limits liability that can’t legally be limited.

Changes to these terms

We may update these terms as FOKL evolves. We’ll change the date above and, for anything that matters, email you before it takes effect; continuing to use FOKL means you accept the update.

Governing law

These terms are governed by the laws of the State of Delaware, United States.
